If someone close to you dies without making reasonable provision for you, the Inheritance (Provision for Family & Dependants) Act 1975 may help you put that right.

To help us check whether you can make a claim, please answer the questions below.

1. Did the deceased live in England or Wales or own property or have some other close connection here?
 
2. Was the grant of probate/letters of administration made less than 6 months ago?

3. Are you:
 
The spouse or civil partner of the deceased;
A former spouse or civil partner of the deceased who has not formed a subsequent marriage or civil partnership;
A child of the deceased;
Any other person who was treated by the deceased as a child of the family in relation to a marriage or civil partnership; or
Any person who immediately before the death of the deceased was being maintained, either wholly or party, by the deceased?
Any person who during the whole of the period of two years before the death of the deceased was living in the same household as the deceased and as the husband or wife of the deceased?
If you answered ‘Yes’ to the above questions, then you may be entitled to bring an application under the 1975 Act. You are entitled to reasonable financial provision.

NOTE: There are time limits for applying under the 1975 Act. The application should be made within 6 months of the grant of probate or letters of administration, though the court may extend this in certain circumstances.
